FREQUENTLY ASKED QUESTIONS

Question What does the City Attorney's office do?
Answer As provided in Carlsbad Municipal Code Chapter 2.14, the City Attorney is the chief legal officer of the city under the direction and control of the city council; and also acts as legal counsel for the Carlsbad Municipal Water District and Redevelopment Agency. Among other things, the City Attorney prepares or revises ordinances, is responsible for all litigation; makes recommendations for ordinances, resolutions or other documents or procedures affecting the legal position of the city; provides legal opinions; attends all meetings of the City Council, and other boards and commissions as necessary; reviews all contracts and instruments to which the City is a party; enforces City laws and regulations; reviews and analyzes all state and federal legislation affecting the City.
Question My spouse is not paying the court ordered child support.
Answer If you had private representation in your marriage dissolution, seek your lawyer's advice to enforce child support payments. You may also wish to contact the County Office of Child Support Enforcement for assistance and advice, (619) 236-7600 or Statewide Toll Free 1-866-230-CARE (2273) or vistit web site at: http://www.sandiegochildsupport.com/
Question My neighbor is violating the CC&Rs.
Answer CC&Rs are not enforced by the City unless the matter is also a violation of a City ordinance. Code Enforcement (760) 602-2703 should be notified if you believe a City ordinance is being violated. This situation, typically a private dispute, is between the homeowners and the HOA.
Question I bought a set of golf clubs through the mail from a business in Carlsbad and I haven't received them yet.
Answer If an item is purchased through the mail and you haven't received the item, this should be brought to the attention of the U.S. Post Office, Mail Fraud Division, P.O. Box 12210, San Diego, 92112.

Because the City Attorney is prohibited from providing private legal advice to private citizens (CMC §2.14.140), the above situations (or similar sorts of situations) cannot be remedied through this office. However, other organizations in San Diego County may be helpful to citizens in seeking legal representation and or answers to general legal questions.
